1.Terms of Use<\/strong>
Your interest in Easy Field Services (\u201cEasy Field Services,\u201d \u201cwe,\u201d or \u201cus\u201d) and our website, situated at\u00a0www.easyfieldservices.com<\/a>\u00a0, is acknowledged and appreciated. This involves our related websites, partner networks, applications, mobile applications, and other services collectively known as the \u201cService.\u201d Upon accessing or utilizing Easy Field Services for Field Service Management, you are bound by these Terms and Conditions. Easy Field Services provides cloud software and applications for businesses, including associated offline and mobile applications (\u201cService\u201d or \u201cServices\u201d). You may use the Services for internal business purposes in the organization that you represent. You may connect to the Services using any Internet browser supported by the Services. You are responsible for obtaining access to the Internet and the equipment necessary to use the Services. You can create and edit content with your user account, and if you choose to do so, you can publish and share such content.<\/p>

4. Free Trial<\/strong>
If you register for a free trial of the field service management software, Easy Field Services will make the applicable Services available to you on a trial basis free of charge until the end of the free trial period or until the start date of the paid subscription period, or termination by Easy Field Services at its sole discretion. Services are offered as-is during the free trial, without any warranty, covenant, support, or liability. Easy Field Services reserves the right to make changes to the free plan or Free Trial at any time with or without prior notice.
i.\u00a0Cancellation<\/strong>: Easy Field Services reserves the right to terminate the Free Trial at its discretion, with or without prior notice.
ii. Pricing Structure<\/strong>: Easy Field Services retains the flexibility to adjust the pricing structure of the free trial or introduce pricing at the conclusion of the Free Trial period.
iii. Paid Plans:<\/strong>\u00a0Easy Field Services deserves the authority to transition the free plan to a paid subscription model, providing users with transparent information and options for subscription plans.
iv. Features:<\/strong>\u00a0Easy Field Services exercises firm control over the feature set within the Free Trial plan, reserving the right to both enhance and, if circumstances require, curtail these features. This strict oversight is integral to adapting to user needs, guaranteeing a clear and informed user experience.
Easy Field Services may modify the features offered in the Free Trial, striving to enhance and optimize the user experience. Any alterations will be communicated in advance to keep users informed.<\/p>

5. Paid Subscription<\/strong>
If you register for a paid subscription plan with Easy Field Services, the applicable Services will be made available to you upon the commencement of the paid subscription period, subject to termination by Easy Field Services at its sole discretion. Any data entered into the Services and customizations made during the paid subscription period will be retained as long as the subscription is active. Services provided under the paid subscription plan are offered as-is, with no warranty, covenant, support, or liability, unless explicitly stated otherwise in the terms of service. Easy Field Services reserves the right to make changes to the paid subscription plan at any time without prior notice. This includes, but is not limited to:
i. Termination:<\/strong>\u00a0Easy Field Services reserves the right to terminate the paid subscription plan at its discretion, with or without prior notice.
ii. Pricing Structure:<\/strong>\u00a0Easy Field Services retains the flexibility to adjust the pricing structure of the paid subscription plan.
iii. Features<\/strong>: Easy Field Services exercises control over the feature set within the paid subscription plan, reserving the right to both enhance and, if circumstances require, curtail these features. This oversight is integral to adapting to user needs, ensuring a clear and informed user experience.
iv. Service Upgrades:<\/strong>\u00a0Easy Field Services may introduce additional service upgrades that may be subject to separate fees.
Users will be notified of any material changes to the paid subscription plan, and they will have the option to continue or cancel their subscription based on the updated terms.<\/p>

6. Termination<\/strong>
Easy Field Services reserves the right to terminate both Free Trials and Paid Plans at any time with or without notice. In the event of termination, users will be provided with options to migrate to an alternative plan (which may include a paid plan) or retrieve their data as outlined in the Easy Field Services Data Retrieval Policy.<\/p>

7. User Responsibilities<\/strong>
Users are responsible for regularly reviewing these Terms of Service. Continued use of the Service after any modifications indicates acceptance of the modified terms, whether on a Free Trial or Paid Plan. Users are encouraged to contact Easy Field Services support for clarification or concerns regarding these terms, regardless of their subscription status.<\/p>

8. User Sign-up Obligations<\/strong>
To access or use the Services, you must sign up for a user account by providing all required information. If you represent an organization, it is recommended that you and other users from your organization sign up for user accounts by providing the right contact information. You agree to provide true, accurate, current, and complete information during the sign-up process and to promptly update the information to keep it accurate and complete.<\/p>

9. Restrictions on Use<\/strong>
In addition to other terms and conditions, you shall not transfer the Services to any third party, provide any service based on the Services without prior written permission, allow user licenses to be shared or used by more than one individual, attempt to disassemble or reverse engineer the Services, use the Services for any form of competitive or benchmarking purposes, or violate any applicable local, state, national, or international law.<\/p>

10. Spamming and Illegal Activities<\/strong>
You agree to be solely responsible for the contents of your transmissions through the Services and not to use the Services for illegal purposes or transmission of unlawful, defamatory, harassing, libelous, invasive, abusive, threatening, harmful, vulgar, pornographic, obscene, or objectionable material. Easy Field Services reserves the right to terminate your access to the Services for any illegal or unauthorized activity.<\/p>

11. Third-Party Applications<\/strong>
Easy Field Services integrates with third-party applications (\u201cThird-Party Applications\u201d). Access and use of Third-Party Applications may require acceptance of terms of service and privacy policies applicable to such Third-Party Applications. Easy Field Services is not liable for any Third-Party Applications and may suspend, restrict, or disable access to them without notice.<\/p>

12. Fees and Payments<\/strong>
The Services are available under various subscription plans. Payments for subscription plans can be made by Credit Card. Your subscription will be automatically renewed, and the subscription fee charged to the Credit Card unless you downgrade or inform Easy Field Services at least seven days prior to the renewal date. Easy Field Services may change the price of any Service or charge for previously free Services, and any increase in charges will apply after the current billing cycle.<\/p>

13. Organization Accounts and Administrators<\/strong>
When signing up for an account for your organization, you may specify administrators. Administrators have the right to configure the Services and manage end-users. You are responsible for maintaining confidentiality, appointing competent administrators, and ensuring activities comply with this Agreement.<\/p>

14. Personal Information and Privacy<\/strong>
Personal information provided to Easy Field Services is governed by the Privacy Policy. You are responsible for maintaining confidentiality and informing Easy Field Services of any unauthorized use.<\/p>

15. Communications from Easy Field Services<\/strong>
The Service may include communications from Easy Field Services, and you may opt-out of newsletters but not service announcements and administrative messages.<\/p>

17. Complaints<\/strong>
Complaints received will be forwarded to your primary email address. You must respond within 10 days, or your information may be disclosed to the complainant.<\/p>

18. Inactive User Accounts Policy<\/strong>
Inactive user accounts may be terminated after 120 days. Prior notice and the option to back up data will be provided.<\/p>

19. Data Ownership<\/strong>
You own the content created or stored by you. Easy Field Services does not license content for commercial purposes unless permitted by you.<\/p>

20. Hosting Location<\/strong>
The cloud facility location depends on your IP address. You may be required to migrate if your region\/country changes.<\/p>

21. User Generated Content<\/strong>
You are solely responsible for transmitted or published content. Easy Field Services may block or remove content violating third-party rights.<\/p>

22. Trademark<\/strong>
\u2018Easy Field Services\u2019 and associated logos are trademarks of Easy Field Services. Use without permission is prohibited.<\/p>

23. Disclaimer of Warranties<\/strong>
Services are provided on an \u201cas-is\u201d and \u201cas-available\u201d basis. Easy Field Services disclaims all warranties, including the implied warranties of merchantability and fitness for a particular purpose.<\/p>

24. Limitation of Liability<\/strong>
Easy Field Services\u2019 liability is limited to the fees paid during the twelve months prior to the event giving rise to liability or one thousand dollars ($1000), whichever is higher.<\/p>

25. Indemnification<\/strong>
You agree to indemnify and hold harmless Easy Field Services from any losses arising from your use of the Services.<\/p>

26. Governing Law and Jurisdiction<\/strong>
Disputes will be governed by the laws and jurisdiction of your billing address or state\/country of domicile.<\/p>

27. Suspension and Termination<\/strong>
Easy Field Services may suspend or terminate accounts for suspected illegal activity, inactivity, or law enforcement requests.<\/p>

28. Modification of Terms of Service<\/strong>
This Agreement may be modified with notice. You may terminate if changes substantially affect your rights.<\/p>
